Would would be liable for this insurance claim ?? PLEASE HELP!!?


My daughter today reversed out of our drive , when she hit a car which was reversing across the pavement going past our house. The rears of both cars were damaged but only slightly (few dents here and there). The car she hit has for many weeks been parked on the pavement obstructing either mine or my neighbours driveways. Also the car is usually parked with two wheels on the road and the other two on the pavement.

After the collision the women and my daughter both got out of their cars to exchange details. The women said to my daughter that it was 50/50 . Both her and my daughter aggreed to split the liability between their insurance companies.
Then I discovered that this women's car was a hire car, which means she will of probably had a nother crash a short time ago. And that she may not be insured on the hire car.

Anyway a few hours later she rings my house and says to my daughter that the collision was 100% my daugthers fault.

So what i want to know is who's liable ??

how the lady has parked has nothing to do it. i say to this day that my neighbor was trying to get me to hit her cuz she hid around blind corners and drove down the middle of the road and waited for the last split sec to get over. u should have called the cops. whoever was backed out the farthest would be the least liable but they are both liable

That is what "No Fault Insurance is For" !!!!

The call back suggests she didn't have
insurance coverage ???

Also check and find out if she had
Insurance in effect on the Vehicle
that was hit...if not call a Cop...

Driving with out Insurance is a Felony
in My State...you are arrested on the spot...
Lose your Licence and Vehicle in the
blink of an eye !!!!

I would believe that the person backing out of the driveway has to be the one using caution while entering the street, therefore being the liable one.

I assume that they didn't file a police report...that would have been the smart thing to do.

Call your insurance company!
