Negligence on homeowners insurance?


Is allowing someone at your house to get drunk and do drugs, then that person commits a crimanal attack on someone else in the house is that negligence on the homeowner part?

Yes because you gave the person permission to do that
by allowing them which means it was full responsibility on your part also insurance wont cover you

It depends on where you live. Here's California's statute:

"No social host who furnishes alcoholic beverages to any person may be held legally accountable for damages suffered by that person, or for injury to the person or property of, or death of, any third person, resulting from the consumption of those beverages." Cal Civil Code 1714(c).

But, don't be stupid. If you have a friend that you know gets violent when he's drunk, do him a favor, and cut him off before he gets out of hand.

It is, you wont generally be covered for that by insurance. The home owner is responsible for access control, allowing illegal activity is something that can void your insurance.

Check the fine print.

If you really think you are right, then you'll have to hire a good lawyer because the insurance companies have won many similar cases in the past.

Yes .... if you enable a person to drink and take drugs on your property and allow it to continue and then the person commits a criminal action then the homeowner can be held liable. Check with your homeowners policy if you are found negligent since it occurred on your property you might be able to recoup monies, i.e. for medical payment to the injured party. Read the fine print on your homeowners as unlawful activity might not be covered.
