Is it illegal for a former employer to cancel your health insurance after two weeks? |
I was sexually harrased at my former employer, after months of abuse, I had no other choice but to resign. They are aslo using illegal drugs, OHSA violations, city code violations, men uranatring all over, inclucing my trashcan. I need a knee replacement and my knee slipped out of socket, I NEED to see a Dr. today. Im looking for legal council please help. I`m in pain. It sounds like, aside from your concern regarding benefits, there are plenty of obvious crimes being committed. You should talk to the department of labor in your state about what rights you have. The employer is usually able to end your benefits within a short amount of time because you are no longer their responsibility. Three avenues either Personal injury lawyer if you where hurt by another person negligence or maybe a employment law lawyer for sexual abuse or a works comp lawyer if injured on the job yes they can cancel the day after you leave. Sorry. There is a law against Constructive Termination. That is where the condidtions are so miserable that you have to quit. even after you quit you can still have a case. If you complained about the things occuring and nothing was done about it that's still constructive termination. sit and document dates and times things happened and talk to EOE. Unfortunately, when you quit a job, your health insurance usually terminates at the end of that month. Check with your state National LAbor Relations Board; generally when you quit, your benefits run out with your last paycheck An employer is not responsibile for your health insurance after you quit the job, no matter under what circumstances. Something you shold have thought about before quiting! With that being said, if there are OSHA violations and City code violations and you want to be the whistle blower then thta is up to you, but I am not sure how that is gowing to help your knee problem! your employer will terminate your benefits as of your last day of work! you can get personal health insurance though if that's an option for you pretty much required by the insurance company. When you quit paying they cancel your policy. But you should have received COBRA notification. If you are paying for cobra, then no. It is not legal for them to cancel your coverage. But if you opted out of continuing your health insurance then yep, it is. yes, they always cancel your health insurance after you are no longer their employee. Sorry you need surgery and that they treated you badly but once you decided to quit and did not take the COBRA option (call their HR dept if this was never offered to you) they no longer owe you anything. They can cancel your health insurance the day you are no longer an employee. Why the HELL would you expect them to pay your health insurance when you don't even work there???? Once you resigned they no longer have an obligation to pay for your medical insurance. You can continue the insurance, but you must pay the full amount. All of the other issues you bring up have nothing to do with who pays medical - you can turn them in if you choose or sue them, but it has nothing to do with insurance. |
