Do I have a case in court? Please help?


Lawyers do I have a case here?
I found a psychiatrist through my ppo insurance network. I researched him and found that his practice was welcoming and great for treating people with social anxiety disorder.
I called to make an appointment with him and they said he is booked up but there was another doctor within the office I could see.
I went in for my first office visit and paid 300 dollars to help meet my mental help deductible and paid with my debit card. The receipt shows the primary doctors name. My second visit I paid 60 dollars which was my copay.
To make this long story short. I had a problem with my medicine and asked to speak to the doctor. They said he doesnt work here anymore he only gave us one days notice and said he contacted his patients.
Turns out this guy wasnt registered for my insurance like the primary doctor is, but they led me to believe he was.
I believe my insurance company is the primary doctor's only insurance carrier. I was not the only patient that was led to believe this guy was covered under this insurance, I believe that because the secretary told me other patients were calling outraged.
This doctor I was seeing was the only other doctor working within the office.
I found the receipt for the 60 dollars signed by the primary doctor that says copay. Obvious proof I was being duped.
I know for a fact there is only one secretary that handles the billing in that office and one secretary at all.
I dont have medicaid I have a very reputable insurance company through my husband's work.
The primary doctory is saying he is in no way affilated with my doctor yet the receipt that has handwritten copay payment is signed by him.
I have a voicemail on my cellphone saying that I am basically out of the money if I don't take it up with the other doctor.
The other doctor agreed to tell any lawyer that I seek that he was only paid 99 dollars. So basically this small office is stealing 260 dollars from me and no telling who else they are trying to steal from.

I am no lawyer. In fact I am in 8th grade. But I am in an advanced law class and we talk about this stuff all the time. And I do know a litle bit about law. My answer to you is: Yes you have a case. I may be wrong. What he is doing is called fraud, as I'm sure you know. What you really need to do is find out ONE more person at the least, who was duped by this guy. YOu need to keep that receipt with his signature, and you need to contact a lawyer as soon as you can. Try to set up a meeting for free. Make sure the lawyer gives you his 100% attention. If not, find another lawyer. They willdefinitley help oyu set up a case to sue this guy, or get him jailed. And if more people come forward saying he did the same thing, then you're sure to have a case. So make sure to spread the word.

Well, unfortunately the better question is "Is it worth it?" If you take them to small claims court you will be out $30 for a filing fee and you stand a 50/50 chance of winning. Then you have to collect the money, which is a pain in the ***.

First why don't you contact the doctor's office, in writing certified mail, and tell them you will give them 10 days to refund your money or you will pursue legal means to gain the refund. After the 10 days I would contact the insurance company and file a complaint for fraud with their internal investigators (they all have them) with the understanding you're looking to get your money credited back in return for them getting all the fees they paid to an unaffiliated doctor.

Then if neither works go to small claims, and see if the judge agrees with you. Remember, the other doctor has to physically show up in court, a statement from him is worthless.

    You can and probably will get sued individually. It depends a lot on whether you were actually driving the car for "business purposes" or if you were just using it. Good luck!!

    Homeowners insurance may; renters insurance (that most people don't have anyway) probably won't. Yes you can pursue a civil action if you can prove fault not accident is the cause.

    It will show up on your driving record but it is a non-moving violation so it won't affect your insurance.
