A friend drove my car and totaled someone's elses car...i had no insurance who's liable for the wreck?


this car is my deceased mother's and the tital is not in my name at the present.

From what I've seen on The Peoples Court, there are 3 people that are responsible for the damages, as a whole.

You for allowing your friend to drive the vehicle
Your friend for being involved in the accident
The estate of your Mom, since the title of the vehicle is in her name.

The total of the damages will have to be paid, in full, by either 1, 2 or all 3 of the individuals/parties.

You are - it is your possession. It is illegal to drive without minimum insurance.

you let him use it, you both are liable.

YOu have a big time mess here. First you better get the person who does own the car involved. 2nd the fact they have no insurance is going to put them in hot water and possibly make them legally responsible for some of if not all the damages depending on local law. Next the guy who caused the accident is going to get sued as well. You, in fact, may be the ONLY ONE HERE who may not get sued; you don't seem to have a financial or physical interest based on what you told us

In the US, a ticket follows the driver and insurance follows the car........................you are responsible.

You just said it's your car.
If the title is in your Mother's name then the car belongs to the estate which will have to pay for damages.
Why do you let a friend drive an uninsured car?
You're not much of a friend are you?
If you " firend " claims that he did not know the car was uninsured and that you told him it was yours, you have a real liability problem.

OK, you'll probably be sued for negligent entrustment, and your friend will be sued for negligence. Your mom's estate may even be sued. Hope that your friend has insurance to pay everything. Otherwise, you'll be hiring your own atty and paying all the medical bills and other costs of the accident. And get insurance today (which is mandatory in every state).

the owner is liable. since the title isn't current you will probably get a huge fine on top of everything else..
