Ok I have a friend and she is being sued for a car wreck that her?


brother wrecked! She took out a loan and got her brother a brand new car! She had insurance on the car but the insurance company paid for her wrecked car not the other car nor medical bills! Her brother now refuses to pay for the other car and so the other company has had her license suspended.
They say all he has to do is make payments arrangement and they will release her licenses and tags but he won't. She can't her sue her brother because she has not paid anything to the insurance company yet so theres nothing to sue for. She had a lawyer but he couldn't help much and theres not reason for her to pay a lawyer for something she already know "ingnorance is no excuse" so any ideas on how to get her brother to pay! Oh and his licenses is suspended too but he doesn't care. She lives in Ohio incase someone knows some hidden laws in ohio!!

It is still on her because she allowed her brother to drive her insured vehicle. Make arrangements to pay restitution and reinstatement fees to the BMV. They will also probably make her drive with an SR-22 bond. What doesn't make sense though is you say they fixed her car but not the other car nor medical bills. I would check further into her insurance as to me, this doesn't make much sense. Liability is usually carried under anyone's policy which pays for damages done to the not at-fault driver and his vehicle. The other driver can also attach to uninsured or underinsured motorist coverage. Check it out.

Rather confusing question, bit let me see if I got the gist of it.

Your friend bought and insured her brother's vehicle. He was involved in an accident with another vehicle. Your friend's insurance paid for the damage to her vehicle because she had collision coverage, I assume. This being the case, it would appear that she also had liability coverage. It is a very rare situation when collision coverage which is optional would be afforded, but liability coverage for the same loss would be denied.

You did not mention how the accident occurred. Was the brother at fault for the accident? If not, her insurance company likely denied the claim presented against them. The other insurance company could not suspend her license or tags. That is something the DMV could do. Are you sure you have the correct information on who canceled what?

If the brother received a letter from the other insurance company, it should be referred over to your friend's insurance company. They should handle the matter on her behalf. If suit is filed, they will have an attorney file an answer and defend both your friend and the brother.

I think some of the details are missing here.
