Unit 8 in our condo burst a pipe, flooded 4 units ; shouldn't unit 8 be financially responsible for repairs ?


Why should my mom have to pay for repairs when unit 8 has insurance ; he should pay for all 3 units that were flooded ; my mom's insurance, St.Farm, saying too bad, so sad, pay for it yourself ; I don't understand. Thank you.

She needs to check the regulations within the condos home owner association. there should be a clause in it when it comes to damages caused in one condo by the negligence of another owner. Sometimes the contractor that built the condo can be found liable and then they would have to pay for ALL REPAIRS. Because each state has different Home owner rights (CONDOS INCLUDED), there may be different agencies you need to contact. You can also pay for the repairs and then sue the other tenant for compensation, but that would take some time. But get all your "Ducks" in a row and the present it to the person whose condo had the pipe burst. In the state of California, the responsibly of all repairs would fall on that owner unless it was the negligence of the contractor then legally they are responsible.

That sounds like a sticky problem - why did the pipe burst? Was it in any way negligence on Unit 8's owners? Contact Unit 8's insurance and present your claim as consequential damage directly related to the leak.

You would have to look first at the owners' association agreement. Usually it spells out who owns what.

You would then have to figure out who owns the pipe that burst. If you want to make a claim against that person, you would have to then show that he was somehow liable for the rupture.

The fact that someone owns the pipe does not automatically make then liable.

Using your own insurance is always the most practical thing to do.

yes the owner of the condo would be responsible, the problem is that condos in that way are like apts, and the maintenance may be an issue withthe maintenance company that has a contract. i would suggest by starting to call you condo association to find out the maintenance company, then i would file a suit against both the #8 owner and the maintenance company.

i would look to my lease for conditions of rent insurance and other. maybe you can challenge the other policy holders if they have insurance also.

You must file a civil lawsuit. Sue the guy and he will have to pay.

If the people in unit 8 don't own their condo then the liability should be with the condo management personnel. Your mom needs to have them pay for the damages. If unit 8 is owned by the people who live there, then their insurance should pay for the damages. If all of them refuse to pay, then your mom needs to get a lawyer and sue for the damages.

In a condo, the condo association (all the owners) is responsible for the physical buildings, pipes, roofs etc.

The condo owners actually only own idividually the space INSIDE the walls of their unit.

It is shared risked for everything else. That is very clear in the papework when she bought the condo.
