Was in a car accident driving company car employer refuses to pay medical bills?


I was in car accident in a company car, it was a hit and run so other driver was never found; problem is that employer is refusing to pay medical bills and he has ho worker's comp insurance so I'm ina difficult position, do I sue his insurance company and hope there's no retaliation? if I get fired can I sue my employer for retaliation? medical bills are in excess of $15,000 and I'm not getting proper medical attention now, help!!!!

You dont mention, but if you had any drugs in your system at the time of the accident they may not have to pay anything. So, was your drug/alcohol test clean?

Since your employer opted out or decided not to have W/C insurance they understood the employees recourse was to sue the employer. Before it goes too far, I would contact an attorney and have them review your case.

I would suggest on something like this

Also, check with your local state's local
"Unemployment Agency" and talk to someone in
the Workers compensation department about
something like this.
I am sure they can help you or tell you where
to go on something like this.

In my opinion, if you were on the job in a
company car and a driver in another vehicle
"hit & run". And police have yet to locate the
other driver.
It seems that your employer and his insurance
company should pay for your medical bills.

The only reason I can see why your employer does
not want to pay for your injuries, maybe he is dealing
with a shady insurance company or has no
insurance for this type of thing you were involved in
which may be illegal in your state(it may be, could
be another reason) and is trying to pass the buck onto
you.

Again, I suggest you get a lawyer to help you out with
this particular matter.

The employers insurance will have to pay. If they refuse, go to the Labor Board and file a complaint. Your boss can not fire you for this, but, could come up with another reason to fire you.
I wouldn't let this go until your bills are paid. The questions I have is, were you doing company business when the accident happened, who was driving? If it was business, the employer is responsible, end of story.

Yes get an attorney, what are you waiting for? No they can't fire you for suing them. (they can come up with another reason, but don't worry about that now) you need to get going on this ASAP! There are time limits on making claims so don't wait and hire an attorney. You shouldn't have to pay unless they collect for you!

Yes, go see a PI atty right away.

In some states, maybe yours, the Workers' Comp. commission/agency/dept (whatever) maintains a fund for workers who are hurt while working for non-subscribers. So you may not have to sue your employer. However, you may wind up having to do so. Ask the atty what retaliation protection you have against him.

Also, your atty should demand medpay immediately from his insurance. It is paid without fault, normally is a fairly low cap, but still something.

sue him big time. you can wipe him out and be president of company (lol). no insurance is against the law in most if not all places.

either way its just really stupid because it makes the company liable instead of the insurance company.

It is against the law for your employer to fire you over a workers comp issue. You can probably find a good lawyer that will take your case on a contingency fee basis, and that's what you need to do.

Contact an attorney. You employer (his insurance company) is liable and should be paying.
