What are my obligations if any? |
I was involved in a car accident about a year and a half ago. The other guy ran a red light and I had a green arrow, and I hit him. He got the ticket, went to the hospital. I testified at the hearing a few months later and was dismissed. Now a year and a half later I am being contacted by his lawyer. He says that he is suing my insurance company, which I am no longer with, but he needs to serve me with the papers and I need to forward them to my old insurance company. I no longer even live in the same state. What are my obligations in this situation? Do not tell him where you live, or give him direction on how to serve you. YOu are not responsible for whatever he is tryong to get. He got the ticket, and you went ot court and it was dismissed. If he got the ticket, that makes the accident HIs fault, not yours. YOu nor your insurance are liable for an accident that he caused. So gether all your info from back then, and contact a lawyer and ask this very question that you asked on here. Also there has to be some statutes of limitations on claimes like this. DO NOT give them information on you current insurance, do not give them anything other then court documents showing it was dismissed and that he got the ticket. Try to get a copy of the ticket and police report from the police station. in the mean time, don't answer your door if you see someone at it with papers in hand. They can't serve you if those papers don't physically touch you. Sounds like he is trying to civily sue you now that time has passed and trying to get money. You didn't cause the wreck, he did. YOu aren't responsible for is bils. You do NOT have to give him any information at all. If I were you, I would give him ONE NOTICE, and make that clear, to not call you again. You are not obligated to do anything at this point. It is his attorneys job to do this. You were dismissed from the case because you were the one who was in the right. He just doesn't want to do the hard work. I wouldn't do anything for this guy. Ask him on what grounds does he want to serve you with papers. |

The insurance company will pay any claims up to the limits of your policy. If you are criminally charged you will need your own attorney.
