Car accident settlement funding?


I was involved in an accident Feb 13. The other driver was completely at fault, as established by everyone's eye-witness accounts and his own admission. My leg was destroyed and he had the state minimum insurance coverage (15,000). I had full coverage plus the underinsured/uninsured motorist (another $15,000). his ins. co. offered me the max to settle. We got a lawyer instead. My question is, say we settle or are awarded a large sum of money and he has no more insurance or other assets. Where does the money come from?

I will add that this is in PA and from what I understand, a bankruptcy filing would not terminate whatever he might owe us.

Is there a fund like the CAT fund that would cover any of it?

If he has no assets you can still win but have fun getting the money.Just because you win a case does not necessarily mean you will receive the money.( remember the O.j case?the family has still not received their money)If he has any assets at all order a writ of seizure/sale.Freeze bank accounts.Some states will make you return to court every so many years to have it enforced again. In Ontario,Canada it is 6 yrs i think.

There is no fund of money for judgments over insurance. He can bankrupt the judgment, and you will be left without anything more than the money from his policy, less what you paid your lawyer.

Before you get upset about him only having 15k in protection, just remember that you do too. If you would have purchased 100k in liability and UM coverage, you would have been able to file against your policy.

from no where, if he files for bankruptcy you are s*** out of luck... if he doesn't file for bankruptcy then he would have to make payments to you...
but, usually in a case like this the person at fault usually files for bankruptcy...
