Notorized agreement?


I let a friend get take up payments on a car I got. We have a notorized agreement. She has made payment on time some times. She has promised to get the car finance in her name but it has been almost 2 years. In the agreement it states that she is responsoble for making the payments, insurance , her tag, and taxes. She also stated that my finance company told her that she could get her own tags in her name . I have found out that she has gotten tags in my name. She has fail to pay the car taxes for the past 2 yrs she has had the car. She has not had the car inspected and I had to cover the car under my insurance being that it is registered to me and in my name. I am afraid that if I take the car from her she is going to try to take me to civil court. So I am not sure if the agreement that we have will hold up in court being that she has not paid taxes and gotten tags in my name with out my permission. I dont know if i should take the car a risk going to civil court.

Ok. Car is in your name. Legal agreement with friend which she has violated. Police will take a look at the agreement and decide it is a civil matter. You need an atty and a trip to court.

Take the car, sell it through the want ads and refund her any money left out of the proceeds after you pay off the loan. The tags and registration are still in your name. You still own it and she is only using it with your permission, which you can revoke at will. If she doesn't get all her money back that was just her payment for getting to use the car and depreciating it by racking up miles

If you take the car back, it will be up to her to take you to court. If the car is in your name, it will be up to her to make the case, not you.

My guess is she probably won't bother.

you can take her to court for breach of contract.

Take the car back. She breached the agreement first.

She really is not a friend.

If you take her to court, you pay all the fees. If she takes you to court (unlikely because of her payment history), she pays the fees.

Then sell the car. It is still in your name.
