I need a legal advice please.?

I got in an accident. the other driver hit me and one other car. neither party had insurance. the other driver got a ticket.my car's totaled. i'm taking to the small claims? what is the worst thing that can happen to me?

The person can only be found guilty of the traffic violations in traffic court. If you had insurance, they should take care of it. If not, bring all your bills, or several estimates to civil court. Worst case scenario is that the other party will be found guilty, and then they don't pay. Then you would have to bring them back to court.

So you did not have insurance either?
You can take them to small claims court but it is doubtful that you will get any money out of them. If they didn't have enough money to buy an insurance policy then it is doubtful that they will have the money to pay for your totaled car.
If you do have full coverage insurance then your company will pay your off for your car and will go after the driver of the other car. You won't have to worry about a thing and they will handle the legal end of it.
Insurance seems like a pain in the *** and expensive to keep but let me tell you it is so worth it to have when you need it! Like in this situation.

You find out the other party is "Judgement Proof". In other words, they have no money to pay a judgement against them.

However, depending on in what state this occurred, a judgement can be from 4 to 10 years and renewable so that if at any time in the future they do have money, the judgement will still be good.
