Legal Question : Child support? |
I'm 22 and attend school full time. I just found out this summer who my biological father (him and my mom were never married) is and he has never paid any child support, college money, or health insurance bills. Can I get the child support money from him I should have gotten all along? If there was an order in place in the past and he simply never paid it, absolutely you can, with interest. But if there never was an order in place, then it's to late, your too old. Every state is different, but generally, you have to have established paternity and started a support order by at least the child's 21st b-day, or they won't do a thing. You've passed the statute of limitations. Here's a good link, find your state, and look in the "support order establishment" & "statue of limitations" sections. It's possible. I don't know what state you live in, but he could owe back child support, if he is proven to be the father. However, this is a 22 year old case, and there other children who are under the age of 18, who need the support for their absent parents more so than you...so I don't know the likely hood of attorney general office making him back pay. But its worth a shot, contact your local Attorney General office and ask As I know. Your father owed to your mother for child support because your mother took care of you such as foods clothes, etc when you was little. It is up to your mother to give you money for your college. You could approach him and ask for his help. He knows he got off easy as a parent. And I applaud you for going to college on your own. Good luck to you. No. It was your mother's responsibility to take your father to family court to have a order for child support. |
