Do they have to pay for medical bills?


I feel outside of a restaurant, in the parking lot walking up to the door. I feel when I went to step up on the curb, it was very icy and I landed hard. I cut the side of my face, sprained my wrist and broke my glasses. Because I was bleedinf from my head an ambulance was called(and since a ambulance was called apparently a police car always shows up). I was taken to the hospital and given stitches. My insurance paid for most of the bill, But I have a $100 hospital bill to pay nad it cost me $37 to fix my glasses. I went back to the restauenat and tried to talk tot he manager--but he basically told me to go to hell. Would I be able to sue, I only want what it cost me $137, but I do not want to spend more money than that to sue them. Is it worth it to sue?

You talked to a stupid manager, there driveway is there property and they are responsible. Call the business back and see if you can talk to another manager, or if it is a locally owner business talk directly to the owner. Businesses have insurance just for this purpose, and they are responsible for the medical bills. If the business is unwilling to pay for them, then you can take them to small claims court. It will cost up to $50 to file but you do not need a lawyer. You could also sue for pain and suffering, and if you missed any days of work due to this. Since the ambulance was called and a cop was there it sounds like you have a really good case. I usually think people are way to sue happy, but your case sounds legit

Yes, small claims court. No lawyers, but some money for filing and serving the papers, which if you win, you can get from the restaurant.

You should not have to file a lawsuit in this case. I would think that the business's insurance company would want to settle this case.

You need to talk to a personal injury attorney. He can probably settle this case without having to actually file a lawsuit.

The sidewalk and such are public property, so it's the counties fault.

It all depends on the prevailing city code and where the property boundary was. Public = lost cause. Private = get you a lawyer. Now if they violated code in the city you may be able to at least get revenge and possibly restitution because of the prevailing laws.

If its on the restaurants parking lot it is up to the restaurant to pay You can go to small claims court where you represent yourself that would be better then hiring a lawyer for such a small amount man. But yes the restaurant is at fault if it is their part of land. If it is off the property of the restaurant then it is the counties and you will have hell probably getting money from a county.
