Is their a way to get money for this? |
i was in a bad car wreck in january...and have not been able to work until last friday. my best friend was the one driving and was at fault but it was pretty fuzzy to me who was at fault. and it was a very simple mistake that i think most ppl in our situation could have made... so i refuse to sue her... but the other lady is...their were ppl with hospital bills involved and she doesnt have enough insurance to go arouns so mine has to pay some of my bills...is there anyway i can get any money for the time i was not able to work.. even tho i am back at work now? You would not be suing your friend, you would be suing her insurance company if they have not compensated you for your damages. You need to talk to an attorney. Go to Martindale-Hubble and search by practice area and look for an AV or BV rated attorney with 15-20 years of experience. They won't charge you for an initial consultation and a case like yours would probably be on a contingent basis which means their fee would come out of any judgment you would receive. Refusing to sue your friend may seem like the right thing to do, but legally, you may be dead wrong. Just talk to a lawyer. You don't have to commit to anything. Just go to the lawyer with copies of the accident report (get it from the police) and any other paperwork you have. If you have alrady received some kind of payout from your friend's insurance, bring a copy of that too. You may have already signed your rights away. Knowledge is power - go get it. If the insurance company of the person at fault in the accident did not take care of your injuries and economic losses, you need to sue that insurance company. Also bring copies of paycheck stubs, your medical bills and medical records to the appointment with the attorney. well depends i couldnt tell if you were working or not before the crash but if you were talk to them and see what their woekamns comp rules are...if you can get on workmans comp they with pay you minumum wage for the period of healing time... You are not entitled to workers comp unless you were in the course and scope of your employment. And yes, you would be suing your friend, and not the insurance company as another poster has suggested. The insurance company was not legally liable for your injuries. All your lost wages,medical and a settlement for pain and suffering should have been paid,either by the person at fault in the accident or by your friends insurance regardless of fault it the other party coulnt pay ( as her passanger she is laible to a degree for your injuries in her vehicle regardless of fault) thats why she pays for medical and liability insurance you need to definitely contact her insurance company and probaly a good lawyer ASAP. Who your sueing ,her or her insurance company ,is irrelevant the insurance company is who will pay in the long run,someones insurance of maybe both partied insurance isliable for your wages,medical and pain..probably whatever carrier is paining for your medical also is responsible for lost wages and a pain and suffering settlement.get something started right awya before the window lapses. |
