Should my doctor be made to pay this?


Ok i saw my doctor on 2/23 for an ingrown nail that was sore. come tto find out from him I also had very smaill infection in it and a fungus infection. He gave me antibiotics and scheduled me to come in 4 days to get the entire nail removed. $ days later I had it removed completely. Saw him 2 days later it was geting really infected was told to stay on the meds and return in 2 days. Came back in 2 days later my toes is clearly seriously infected he gave me a stronger antibiotic told me to come back in 2 days. I did at this point my toe where the nail should be is black swelled up 3 times in size and is oozing pus.He puts me then in the hospital for IV I had to get surgery to get the nailbed scraped I spent 6 days in the hospital with a bone infection and a possible staph infection. I now have 18000.00 in medical bills and my insurance is even going to pay half. Does this count as malpractice? Any lawyers out there or people with similar experiences that can help me? Thanks

Your question maybe better suited for the health section b/c to have a case you have to know whether or not the care you received was below the standard of care.

My friend had the same problem and ended up having his toe removed. The doc more than likely did everything possible. Sh*t happens.

It can be malpractice. the thing you will have to prove is that he deviated from accepted protocols with respect to this procedure. It sounds like this all happened over a week, and he tried to prevent the situation. You need to find a lawyer in your area and talk to them, as they know the specifics for your area. If you can find one that will take the case on contingency, then go for it.

You don't want our opinions. You want to talk to an attorney who specializes in malpractice.

Offhand, it's not a clear-cut case of the doctor's incompetence or wrongdoing. (It's not like he removed the wrong toenail.)
