In a car accident (in Massachusetts) that wasnt my fault, now being sued by other driver for reckless driving! |
I was in an accident last April (so just about a year ago now). Basically, a SUV cut accross 2 lanes of traffic and crashed into my car (saturn). I have a witness, an off duty cop saying that it was not my fault and my insurance company found me %100% NOT at fault and waived my deductable and everything. I actually have contacted my insurance company's lawyer, he was actually on top of this and foresaw a possible suit coming after he had already sent a statement to the guy who hit me attorney saying that he believed I was not at fault in the accident. My lawyer said that they would have 3 years from the day of the accident to file a suit against me and pretty much 1 week after my lawyer told me that , I was served with papers from the sheriff's office. Contact your insurance company and let them handle it. If you have a witness, an off duty cop, and an insurance company sayd you werent at fault then no need to worry. Hell, you have a cop so the judge will hear that and plus going across 2 lanes of traffic within like 500 ft is a violation so you'll be good. Only in the land of liberals and ted kennedy. was any one sited of the accadent? I would call your insurance co. and tell them what is going on. ( if you were at fault your insurance would have covered their "injuries") If you insurance co says that they cannot help you I would contact a Reputable lawyer ( not one you see on tv). If you found not at fault they should not be able to sue you. Call your insurance company and send it on to them. They'll fight it. That's what you pay them for. I think that this case will be thrown out....I also think you should countersue, because its sounds like your the one w/the case. Your insurance company should handle this for you. |
