Ticket for 25 miles over speed limit in new york, pleaded not guilty, any experience?


first of all i was going 56 apparently on a 30... this road is right off campus and i was not the only car going that fast... i was on E and to be honest other cars were going faster than me and I wanted to get to the gas station in time... i pleaded not guilty... how long will it take, will they reduce it? what can i do to not have points on my license and get my insurance raised...

Yes too much experience on this... 1st time, no attorney, was stupid... book thrown at me...

2nd time, 5 charges... over 20mph over... added reckless driving because of the speed... hired an attorney for a measily $300 bucks... didnt even have to show up in court.. all charges dropped.

Your question is rather funny. Gas runs out based on how much you are using, not how long it has been on "E". Your car is going to run out of gas when the tank is empty. Driving faster simply increases your usage and makes you run out sooner. Next time, remember that your best gas mileage, depending on the type of car, is almost always less than 50 miles per hour. Therefore, if you had been going 35 to 40 miles an hour, you would have still made it to the gas station and you wouldn't have a ticket.

BTW, if you know you know you were going 56 mph in a 30 zone, why did you plead not guilty? I could understand if you had a mechanical problem or were questioning the method that he used to ticket you because you sincerely believed you weren't going that fast. Seems like you should have at least some point to argue other than to simply lie about your guilt.

You were going almost twice the speed limit. They won't care why.

Call the county bar association to ask if they have a lawyer referral system for a brief interview with an attorney for a small fee. Ask him, or her, what are your options.

I think there's no chance out of fines and other penalties. You might get some reduction if the judge believes you didn't intend to go that fast. Say you were in a hurry for fuel and just followed the others. Don't imply "why me, they were going faster," (like you did above) or you'll blow the whole plea. He'll think you're just trying to weasel out.

You might have a chance at traffic school, to cut a point from your record (if New York offers that), if you can convince the judge you never do that ordinarily.

why do you have gas below a quarter tank anyways,that aint to smart

if you have a good driving record, plead not guilty. then say you are representing yourself pro bono and ask to speak to the assistant district attorney. you can do so at traffic court on the nights the da is there and cut a deal.
