Warrant for my arrest.?


Good Afternoon, in Feb. I received a ticket for speeding and driving without insurance. I was let go and the car not towed because I was 8 months pregnant. Thing is that I was suppose to show up to court on March 11th, but had the baby on the 9th and was not released from the hospital until the 12th. I called that Friday to see what the status was on me and the clerk said to call back that following Tuesday. Thing is that they issued a warrant for my arrest for failure to appear. Question is what do I need to take to court with me and will I be arrested??

You should go to the court house and ask for a trial date. Bring evidence that you were in the hospital on the date that you were supposed to appear, such as a bill for the time or even the birth certificate.

It is within the judges discretion weather or not you are arrested in court. If you have contact with law enforcement between now and then, you will be arrested(THE OFFICER HAS NO DISCRETION). Politely explain the situation to the judge and politely ask him to with drawl the warrant and give you another court date for the citation. Do not miss court because then you will have another warrant for failure to appear. Good luck...

You need to speak to a solicitor before you go to court because a warrant has been issued for non appearance you can be arrested, so you need to seek legal advice and when you do you need to bring proof of when your baby was born and when you were released from hospital. You will also need someone to represent you on the driving charges.

Well a good start would be all the documentation you can get your hands on to verify that you were in the hospital and unable to make your court date.

I'm not a lawyer, so I don't know what legal items you need to have with you. But I would imagine you really should take your baby and his/her birth certificate with you. Bring your discharge papers from the hospital too.

Congratulations, by the way. I can't imagine they'd lock up a woman with her newborn baby.

Take your hospital papers to the courthouse and ask to speak to the duty judge. I'm sure the warrant will be set aside and your case rescheduled for another hearing.

It's a bench warrant. Did the ticket give you options such as to pay a fine? And what city was the violation in?

My city has pay by phone where you don't even have to bring the ticket or appear. The traffic classes used to reduce the fine, but not anymore it only reduces the points on your driving record.
