How long does it take to recieve a settlement?


This Q is for my mother.
her spouse was hit by a drunk driver and killed.
How long till she gets a settlement from the drunk drivers insurance company?
months or years?

This happened March 10th this year.
She already has a lawyer and apparently the lawyer and insurance company have been talking already. She just wants to get it over with and come live with me.

If the drunk driver's policy limits are relatively low, say $100k per person/$300k per accident, then settlement should be forthcoming as soon as the liability investigation has been completed. If your mother is filing a loss of consortium claim, that could delay the settlement if your state allows a separate limit for her claim.($100k stepdad, $100k mom). Most states do not allow separate limits. Consortium claims are included in one limit.

However, if her attorney is filing a claim for punitive damages, and depending on where this accident occurred, it could take quite some time before any settlement is reached. Also, if the drunk driver has high liability limits, then it may take longer to resolve the claim.

Your question is very very interesting! I had dated a guy years ago who parents were hit by a drunk driver, and his mother was instantly killed, and his Daddy was severely injured and in ICU for a long time. His Dad is now on Social Security. It was years before they got a settlement. The lawyer will help with expenses. It is a good case and so the lawyer will help out and loan money as it will take time to get a court case and even then, the insurance takes their time to write the check. Then the bills have to be paid. Keep track of the money the lawyer loans you because the lawyers can try to cheat a little,

It could take some time. She will first have to contact the insurance company and they will have to offer a settlement. Pnce a settlement is offered and accepted, in writing, the payment will take about seven to ten days. The time is taken up arriving at an agreeable settlement.

Certainly months, possibly years if they fight it in court.
