A long question that needs to be answered for extra credit for school? |
lets say that a minor(around 17, for example) takes his parent's car out to the electronics store for his selfish needs. But the catch is that the minor doesn't have a licease or permit, not anything. & also, the minor bumps into another car w/ people in it. there is no damage whatsoever, nobody was hurt, but the minor has to go to court for a suspension to get his licease. BUT, the judge didn't send the notice for the court date yet. The question is if the minor gets his licease before the court date, is the case dismissed, or is there an alternate punishment? Btw, no, tats not me cuz.... If the minor does not possess valid auto insurance, he/she will likely be charged (unlikely sentenced), be placed on probation, and have his/her license suspended. i dont now for sure maybe google it??? Thats tricky. According to Air America's Lionel (an attorney - and brilliant talk show host BTW), the answer to any legal question is ALWAYS the same .... " It Depends". Run RUN RUN RUN never come back Driving without a license. Things will be in your favor when you show up to court and have proof of a drivers license. The judge will probably still take the "minor"s license away for a period of time. It depends on the state, I believe. Most states have laws that take your age at the time of the incident. Few others take your age at the time of the court. he will probly wont be able to riveve his lincence the real question is was this you? :) no it wouldnt be dismissed. they would still bring him in and the judge would decide most likely to take his license away for awhile. I'm sure that it will be an alternate punishment. When the judge sees the date of when the license was acquired and date of the accident he/she will know he drove without a license. Things like that don't get away easy. Of course the kid is guilty since he will probably be booked before he even gets into court. which means he will probably get booked on the scene lol. This doesn't sound like extra credit. Sounds like a situation you may have gotten yourself into. But to answer your question, no, the case will not be dismissed for the simple fact that the person has committed a misdemeanor, which is driving without a license. They can't ignore that and the judge will frown upon it. As for the "alternate" punishment, there might not be an "alternate" one but the judge may make the person pay a fine and/ or do community service and will definitely suspend the license regardless of the time that person has or will get their license. In the end, it's up to the judge but I can promise you that the odds are not in his or her favor. Also, driving without insurance is a nice ticket and fine. |
