Is it illegal for an alcoholic to say he does not drink?

If the alcoholic is in recovery, then no, it's not 'illegal' to say s/he does not drink ... but since there are many health issues that come with alcoholism that could make a difference in the insurance payments, it must be stated somewhere that the person IS an alcoholic, so those things can be considered. In other cases, if the alcoholic has been arrested for driving under the influence of alcohol and has had no alcohol, the 'line' is much thinner ... it's 'illegal' not to admit to being an alcoholic, but this person hasn't been drinking (or using drugs) and that person could then 'admit' to being a user 'in recovery' but not admit to having had the substance they were arrested for using ... so it would be perfectly legal to say that s/he does not drink any longer ... or simply does not drink, since that sentence is in the present tense and no past tense should be applied.

Well, it depends.

If it's something under penalty of perjury, in a government form, then yes, it's illegal to lie.

If it's something for an insurance company, it's not illegal, but if they discover it, he can forfeit any benefits.

Also, I should point out that there are millions of alcoholics who don't drink, so it might not be a lie at all.

If he lies on the application, then technically he may be voiding whatever contract he makes with the insurance agency. That means that even if he pays for months or years worth of premiums, the insurer would be within its rights to deny his claims when they find out that he drinks. It's in his own interests to answer the questions honestly.

Illegal, no. He will not get arrested for it. He could be denied coverage if it was later found out that he does still drink.

Another issue is just how the question is worded. If he has been sober for some time, and the question is asking if he currently drinks, then he is answering truthfully by saying he doesn't.
