Yesterday, a truck backed into mine.... he is denying fault?


I was at a supermarket parking lot. I was signaling to turn left into a parking space. In the meantime, and man in a big pick-up truck barreled out of his space, (we were directly behind waiting to pull in the other spot) and struck the passenger side of my 4x4.

Our insurance co. Geico, says def. his fault. There is a police report, and all. I took pics. He has little to no damage... I have moderate. Of course, he says he didn't see me, and can't be his fault.... so who is right?

P.S. I had 2 young children with me at the scene, he didn't even ask if they were ok, he was a real jerk....

Hello Cara. Anytime a person is backing their vehicle out, they are responsible for their actions.

Legally, even if this is considered private property and the Police claim it as no fault, the insurance company will still find the backing vehicle at fault.

Let your insurance company deal with it. This is a very common occurance and they are fully aware of how to deal with it, regardless of what the other driver claims.

PS...and this is something I have tried to get my darling Hunny Bunny to understand also.....if you back out of your driveway and are involved in an accident, it is YOUR fault. Even if the other vehicle is speeding (which you cannot prove), it is your fault for failing to make sure you are safe. I have always backed in our driveway so I am pulling out forward.

The police report should have said whose fault it was. And yes, you should let your insurance company handle this, because that's their job. I strongly suggest you refer him to your insurance company and don't engage in any more communication with him.

No one has to agree with you and no insurance company has to voluntarily pay up. He is probably denyin liability either because he doesn't understand the duty to look or because his insurer has instructed him to admit nothing. Your two insurance companies can fight it out.

He is at fault period, any time you back out of a space you have the legal duty to ensure its clear to back up, its immaterial that he did not see you, since he had a legal duty to ensure it was clear

He is at fault. He should have looked. Do you have comprehensive insurance? If so, just let Geico go after him for you. If not, you may have to take him to small claims court.

You're fine. Insurance. police report, pictures and he HIT YOU.

just let Geico handle it. That's why you pay them the big bucks.
