I hit someones car and.....? |
I was backing out of a parking place, it was dark and icy. I only saw a tree and drove away. Later on cops showed up at my door and now I'm being charged with a hit and run. The parking lot I was in is a private drive, so hitting their car is technically property damage. The people have changed their story four times, ranging from only hitting their door, to crushing the whole right side of the car, and now they are saying I injured the driver of the car (who on police reports said he was getting luggage out of the back of the car, and to the insurance company said he was in the driver seat and now has a serious back injury) but, the passenger didn't get hurt at all. My car only has a barley broken tail light. But now they are saying they are going to sue me for their injury's. 1) Contact your insurance company and ask how they are planning to defend you. If you are satisfied with their response, stop there. I had something like this happened and was mortified and scared. This is what happened. I was backing out of a grocery store spot and sideswiped ever so gently the car next to me. So light you would not even know. Didn't feel anything really but knew I had done it. There was a lady from China in the car. I stopped and she got out screaming at me in Chinese. As I could see there was absolutely no damage, I moved on and left. About an hour later the cops showed up at my door. I lied and told them I tried to talk to the woman but she only spoke Chinese. Well, the woman claimed she was "injurerd" and wanted to sue me. I told my insurance company this was a fake. They agreed because there was only $300 damage done to her car. As it was,she was not able to PROVE that the injuries she was complaining about stemmed from the hit and run and the suit was dropped. She was just looking for a handout. You can't just "sue". You have to PROVE injuries and they have to be substantial too. The people are going to have their hands full proving injuries. The lawyer for your insurance company is going to look at their medical records, see if they have past back problems, etc. and go over everything. So your insurance company is being sued, not you. So calm down. If you need to talk more, let me know. What's going to happen if you are smart is your going to hire an attorney to get his all sorted out--the criminal case as well as the civil case. report it to your insurance company and let them deal with it. that is what you pay them all that money for! |
