Insurance question, my buddy got pulled over last night Sunday 1AM, the officer said he run? |
his tags and showed no proof of insurance!! My buddy showed his insurance card, the officeir still said the car was not insured!! the car was inpounded and he went home. I would get a letter from the insurance company and your last check made out for the insurance payment. Then go down to the court house and demand that you get reimbursed, if that doesn't work then I would call your insurance company and tell them you want them to reimburse you or they will lose your business. take the police force and the insurance agent to small claims. One of them messed up make the court decide which one and get you your $90 back. The no insurance ticket will be quickly dismissed by a judge when you show him/her that it was actually insured. As long as the card he presented says its a valid proof of insurance then the police are being unjust. I have never heard of the police being able to access a system where they can tell if a car actually has insurance or not. Smells fishy. Well, your guy can plead not guilty to the citation, and bring in proof that he's not guilty when it goes to trial. (Really, if you bring it into the prosecutor in charge of the file, the case will likely be dismissed). As for the $90, good luck. Having a card that says it is valid means nothing. One could activate an insurance policy, pay the premium, received the insurance card than cancel the policy, and retain the insurance card. typically, a letter from the insurance company, saying the policy was inforce as of the infraction will eliminate the charge of not being insured. You need to involve your insurance agent; that's what they get paid for. If getting away from work isn't a big problem, you could ask for a jury trial just to bring this injustice out into the open. Whatever it takes, that fine should be refunded. Learn how the system works, go from there. |
