Do you think this is insurance fraud, or even legal???


I carry medical, dental, vision, all coverage 100% insurance for my daughter, who is 11 years old. She lives with her mom and step dad who is very controlling and they keep everything about her from me. For the past 2 years the step dad has carried medical, dental vison on her without my knwledge. My insurance is never billed for any of her services, which is court ordered that I cover her, and I have awesome insurance that covers everything and anything. Step dad has taken her into appointments, when his insurance won't cover something her has actually given my personal info social security#, etc info he shouldn't even have and he pays copays from his insurance thinking mine won't get billed or I won't received correspondence back from my insurance. I have wanted to contact his insurance, especially last week end my daughter informed me step dad took her in and she had oral surgery on her mouth. I am suppose to be told about any medical anything and wasn't even told of surgery.

Sounds like a judge needs to have a little talk with her step-daddy about invasion of privacy. He has no right to her personal info. Is he going to take her in for her first pap smear and boob exam?

That isn't right! Take it to court.

It's not illegal and it's not fraudulent. As far as how it complies with your custody arrangement, you'd need to consult your attorney.

Sounds like you should call your attorney and request a hearing.
If that guy is using your social security number to apply med bills to you, that sounds pretty shady.. Id have it looked into.

From a legal perspective, medical insurance contracts ususally have a "coordination of benetits" clause. This requires anyone covered by two policies identify that fact and prevent both companies from paying the same bills or one company from paying for all services when there is a policy that may also cover a given service. So, aside from the obvious moral issue with his being so involved with your daughter's private medical issues, both you and he may be in hot water if the insurance companies get wind of this. A very real reason for you to speak up.

Yes, it's legal and no it isn't insurance fraud.

Step-dad doesn't need your permission to have your daughter added to his insurance plan. It's actually pretty cool that he does, though, because it costs him money and he doesn't have to do it. And while it's court ordered that you carry medical coverage for her, it will never be court ordered that she can't have any other insurance coverage by anyone else.

Many people have dual coverage. (Which is your daughter's situation.) Most of the time when people have dual coverage the provider bills the main insurance and then bills the secondary insurance for whatever the main insurance didn't cover. It's legal because they're not "double-dipping", but only collecting monies to cover the full cost of the care given.

With or without your SS#, your insurance can be used if she's on it. (Most insurance companies actually put your SS# on your card and that of your dependants covered by your carrier and policy.) They don't need to use it to bill your insurance company. They already have it.

And you can call the step-dad's insurance all you want. Not only will they not talk to you since you're not a member, but even if you were, they are prevented from discussing your her health care with you because of HIPAA regulations.

Health care is one of those areas where parents don't ALWAYS have the last word when it comes to the care of their minor children. At eleven, yes...you should still be informed of whatever is going on...but by the other parent, though.

I wouldn't say it would fall under insurance fraud, but Identity theft yes. Check your credit report to make sure this guy is not using your Soc# for anything else.

Typical situation, Millions of fathers are in the same boat.
The rights of Fathers are constantly being ignored by mothers and the Courts. We need to get together and fight for our rights.
It is ridiculous that we pay 100% of raising the child but only get 10% custody.
It's high time we take back what the women took from us!

Why aren't you asking your attorney this question instead of a bunch of boobs on Yahoo who may or may not know anything???
