Money owning for accident without insurance.?


IF someone is in a moter vehicular accident and the party that caused damage to the other person was in breech of there insurance, and the insurance company doesn't cover them, what happens?

Will the person have to pay out of his pocket for the people injured int he accident?
And if so if it Is a huge amount will the insurance company pay the person injured, and will the driver(without the insurance) have to pay back the insurance company for the money?

If a person doesn't have insurance, they are libel for the damages.

If the person injured has full coverage (meaning that they have insurance that protects them against those that break the law by not having insurance), they will be paid by them - but the insurance company can and will get a judgement for the funds paid. Depending upon the state, that means that they could put a lein against property of the one that did damage - or any number of ways to recover the money lost.

If you do not have insurance, they will not cover you. In that case the only way for th einjured person to collect is to bring a lawsuit against the uninsured driver.

Since they were operating the vehicle without insurance (i'm assuming your state has laws that require insurance on cars) the lawsuit will take into account that they were breaking a law when they had the accident as well.

by breech as in the policy lapse due to missing a payment?
if the policy is in breech, then the driver in question is not covered
which means all expenses will be out of his pocket
his former insurance company will not nor are they required to cover anything if in breech

If the driver at fault does not have insurance, the insurer will not cover him, and will not defend him in ourt.
The driver not at fault may have "uninsured motorist" or "underinsured motorist" coverage, so if the driver at fault was driving without insurance, the other driver may bring a claim against his insurer for coverage. In addition, you can sue the driver at fault directly for damage (but you can't get blood from a turnip; so if he doesn't have money, he won't be able to pay the judgment).

I hope you have uninsured/underinsured motorist coverage. If the person had no insurance or they were "in breech of the insurance contract" you can sue them in civil court but that doesn't mean you will ever see the money. Good luck in getting him to pay for your car to get fixed or any medical bills you and your passengers may have. As with everything this depends on your state.

without insurance, the person will have to pay out of pocket, unfortunaely if they dont have much or nothing, you get nothing.
