Not a listed driver on insurance policy I got into an accident what to do?


I live in the NY. I was Involved in a accident and hit a bicyclist. I'm 100% not at fault the police report & and street witnesses back me. The bicyclist is now suing my brothers insurance & I (America go figure). I live in the house with my brother but was not listed as a driver to keep the premium cost down. After the accident the insurance co forced to be added as a driver and made me pay the difference of the months I was not listed. I keep getting calls from an a investigator from the Insurance co. I've heard many BAD things about this POPULAR Insurance co so I've been dodging his calls for now, I'm very wary of answering his questions because I was not listed as a driver at the time of the accident, and I don't know if hes on "my side" or his intent is extracting info from me to disassociate the liability the Insurance company has or may have to take care of the claim on the insured car involved. I have to speak with them, is there anything I should or should not say?

You should not speak with him. Your brother's insurance company will handle this. Don't talk to anyone but them. Also notify his insurance company of the calls.

Tell them what happened and make sure they have the accident report. If your brother owns the car and was carrying insurance the general rule is when you lend someone your car you lend them your insurance. I got into an accident about 6 months ago with my girlfriends car and her insurance had to pay. I have great insurance and that is what they told me.

Insurance has to cover the car you were driving and has to pay so tell him to talk to his insured driver and leave you alone! You dont owe a penny! I know your situation and got off scott free! Just be silent and let them pay for what they are supposed to pay!

I don't know about the laws in NY, but this all depends on if the insurance is insuring the car or the driver - in CA it's the driver that is insured & any car they drive. It may be different in NY. That being said, if you're not listed as a driver and are insured on your own policy, your own insurance should cover this accident. If you were driving your brother's car and were NOT covered under any other policy, then his insurance company may very well come after you to be reimbursed for any costs associated with this accident. If you have your own insurance, contact your agent and explain it and let the insurance companies battle it out. If you weren't covered at all at the time, you may be getting hit with a lawsuit from the insurance company - better talk to the guy and find out where you stand. Also - If they made him add you as a driver, and forced you to pay back premiums, then I would say they should treat it as your being covered at the time of the accident and not go after you for it. The only way to find out what they're going to do in that case is to talk to the guy unfortunately. again - not sure what NY laws are, but hope that helps either way.

DO NOT TALK TO THIS GUY. Just tell him to speak to your brother's insurance co. Since it was not your fault, they will probably offer the cyclist a settlement (it's cheaper than going to court) and it will be over with.

Refer all calls to your brother's insurance claims manager and/or legal dept. You don't have to dodge calls; just ask for the phone number and say why. Don't say anything else. Ask them to not call back. If they do, claim harassment. Record the calls from then on, after notifying caller that you are recording.

you are at fault . so follow the link. your brother allowed you to drive the car so he is at fault and must pay the the bicyclist 20 thousand dollars. but you hit the kid on a bike so you owe your brother 20 grand. also, you just admitted to conspiracy to insurance fraud online you are going to lose big if this goes to court.

if the car you had accident with had insurance coverage at the time of accident , then the insurance co. is responsible to settling the matter therefore you must contact the insurance co. only
