Automobile Insurance Question...?


I was involved in a accident a bicyclist was riding on the wrong side of the road & on the sidewalk. I was pulling out of my dentist office and she ran into my tire.

I got the police report and she was at fault. However, my insurance company claimed me at fault until they rec'd the police report & then put me a 50% at fault.

This is the insurance company telling me I am 50% and the police report saying she is at fault.

Does the insurance company have to give me information regaurding the settlement to her? I never rec'd any information from Geico.

Insurance Companies are famous for seeing things in the light that allows them to raise their rates.

Try calling and explaining the situation, if you don't get satisfaction, get a supervisor on the phone.

Consider an attorney, (they have their purposes, this may well be one of them)

You might also consider another insurance company, who'll listen to you, (or at least read the police report)

Why in the heck would you report a claim on a tire?

When crossing a sidewalk exit you are required to give right of way to pedestrians. Where there is no prohibition against bike riding on a sidewalk a bike rider has the same status as a pedestrian tho' s/he has a greater duty to avoid collision than one on foot. Barring an impediment to your seeing the bicyclist you had an obligation to stop, & make sure you could cross without cutting off the path of a pedestrian. The only reason you are not 100% at fault is that the "pedestrian" was on a bike.

They will provide settlement information to a extent to protect the privacy of the claimant. You have insurance for a reason: to protect your financial well-being. On a incident like this though it would be 50/50 because you were backing out. You still hold responsibility somewhere in there. Your insurance might increase or might not. Call Geico and ask them what your accident threshold is..thats what your payout has to exceed in order for payout to occur on a at-fault accident. Thats what raises the price..not the rates.
