Insurance Company Lawsuit Settlement?


I got hurt and broke my wrist because of my landlord neglience. He left a pipe that was out 6inch of the ground. And i trip over it. So i got a lawyer and Im now in the process of suing him/ Insurance Company. for premise liablity. Will the insurance company settle quick? If so why or why not?

the ins co will try to run you through the mud & blame you... kind of a "throw spaghetti against the wall... whatever sticks, we will go with it" approach.. just be ready for it.

my concern is that, why hasn't your attorney advised you on this? is he so bad that you have to resort to yahoo answers for enlightenment?

That is a question for your lawyer. It all depends on the facts and the insurance company.

The insurance company will settle, the lawsuit that is, with you only if they feel it is in their best monetary interest. I am a bit surprised that you needed to sue the landlord and the insurance company as it seems a simple claim for your loss should have sufficed, especially since the fault seems to be clearly with the landlord.

If you had a claim denied by the insurer, they will probably dig in to hold out until the cost exceeds or approaches exceeding the amount of the claim. You need to realize that insurers are in the business to show a profit and that will be their overarching viewpoint. The short answer is, ask your lawyer.
The more complete answer is, the insurance company probably will not settle quickly. It is in their interest to pay as little money as possible for claims made against their insured, regardless of legitimacy.
One mistake I see clients making with their lawyers time and time again, is that they assume that any delay or shortfall in settlement is the lawyer's fault. Just apply a little logic to this: Your lawyer is on your side. It is his or her job to protect your interest and get you what you are entitled to. The job of the insurance company, on the other hand, is to make sure that it pays out as little money as possible. They are not there to help you or protect your rights. So when they take a long time to settle, they are hoping that you get frustrated and go away. Same as when they make an offer that clearly falls short of what you should be getting. (Though you also have to consider that any claim, regardless of how straightforward it seems to you, need sto be fully investigated by everyone, including the insurance company and your own lawyer, and this takes time too. Sometimes a fast settlement is not a good idea because all of your rights may not have been explored.)
So do not be in a hurry and don't assume that your lawyer is not helping you. The insurance company is not there trying to hand you bags of cash, it is trying to delay and deny your justice in the name of its own bottom line. Talk to, work with and trust your lawyer.

I would consult your atty. There are so many other variables not addressed that it would be irresponsible to try to make any decision with out more info.
