Auto acident, no insurance blackmail? Help what can i do?


Hi, was involved in an auto accident a month ago. Insurance had expired. Guy slammed on his brakes on the freeway on-ramp because of a free way traffic control light that turned red. He immediately admitted fault and got all my information then left without giving me any of his. Still in shock i did not remember ask him for his and left shortly after.
He called 2 days later asking what i wanted to do and i told him i have no money and no insurance, there is nothing i can do. He repeatedly asked me the same question leaving messages on my cell saying did not want to get insurance involved. My cell was turned off 2 weeks ago and i had no way of contacting him.He has since sent me a letter stating he will report me to the DMV and highway patrol as a hit and run if i don't not reply.He did not give me any information about his insurance in the letter. Is this blackmail/extortion? Is he braking the law by not giving me information?Can he still file charges?(i live in California)

How is anything you wrote here blackmail or extortion? You need to deal with this guy. Either now or after he gets his insurance company into it. Because if you refuse to deal with him, he probably will report it so that he can fix his car.

No matter what he said at the scene, it sounds like this is your fault. You are not supposed to be following so close that you cannot stop if someone has to stop suddenly in front of you.

So talk to the man. Get his estimates for damages and figure out how you can pay him.

If he "slammed on his brakes" and you rear ended him, it's YOUR fault, not his - regardless of what he said at the scene. It is YOUR responsibility to stay far enough back that you can stop if you need to.

What he's doing is being nice to you. He is perfectly free to report you to DMV and the CHP for driving uninsured as WELL as suing you for his damages.

If you hit him from behind you are at fault. Usually police are suppose to document an accident, if he left first that does not sound like hit and run.
