Is it legal for my car insurance company to call a 3rd party' insurance company to seek whatever information ? |
My wife's car was hit from behind and other party's car insurance (Company A) settled the claim. Now my wife drives my car (of course she's insured too) and hits someone else's car. Now my insurance company wants me to give them consent to call insurance company A who have nothing to do with this latest incident. Is this legal?? Of course. They are exploring the record of your wife, and if you refuse you will likely lose your insurance and have a hard time finding another company. It's perfectly reasonable for an insurance company to use measures like this to check facts you have supplied, and investigate driving records. Thats why they ask for consent. its legal to ask, they may want to get medical records and anything they can get to try to deny the claim They can ask you, but they definately can't go ahead without your permission. You are guaranteed that they will not look kindly on this when adjusting your premiums, but that's life. Tell them to get a warrant like everyone else. It's perfectly legal for them to ask for your consent to call company A. However, it would be illegal if you did not give your consent and they called anyway. That's why they ask for you to sign a consent form, bot it's your decision to give it or not. If they are asking your permission then its nothing legal so I personally would not give it. You don't have to and as it has nothing to do with this accident tell them they do not need to contact the other insurance. I think they are just looking for a way of not paying out the claim. it is if you give consent.so you can refuse. However if you do decline it will at best slow up your claim. In all likely hood they will want to see the reports appertaining to your wife's original accident to ensure that they have not got a serial claimant or a very poor driver on their books . the choice is yours of course if it has nothing to do with it what are you afraid of? |
