I need to find out about what insurance company someone have?


Im looking on information on someone. Because he isnt responding to my lawyers demand letters. I got hurt due to his negligence. My lawyer and myself is trying to work with him. My lawyers have sent two out to him already. Its been going on since May 1st. He havent notify his home insurance company. Because they would of been contact my lawyer. And i know he have insurance because the apartment building/ house he took out a mortgage for the building and in order to take out a mortgage you need to have home insurance. I know the company he took out the mortgage for: Century 21 Mortgage, I know the Loan number, His name address. Would that help me with finding out what home insurance he have?

Well, this is interesting. You know the name of the mortgage company and his loan number. He could have 2 insurance companies, but that's a lot of bother so he probably only has one insurance carrier. If you go away and file the lawsuit, you can subpoena the records from the mortgage company. I can remember your previous questions and you are being stonewalled. I can think of several things you can do--but I think the best thing you can do right now is to make an appointment with your lawyer and find out what his/her plan is. If your lawyer doesn't have a plan, I agree with one of the earlier answers---get a new lawyer. This has been a problem for you since May. Your lawyer should have a solution. You've gotten some good answers here--but what you need is action, not words. It's now July 19th--your lawyer should have a battle plan for this case and you should be told exactly what it is.

There's no guarantee this person has liability insurance. The mortgage company wants to see a fire insurance policy. The liability insurance is separate from the property coverage in the commercial world.

After the lawsuit is filed, your lawyers will file a demand for disclosure of "the contents of any insurance or other agreement whereby any third party is or may become liable to pay the damages awarded to the plaintiff." If there is no insurance, you still have the building to go after, so there is likely going to be a fund to pay your damages.

Here's a clue: you're being stonewalled. Stop negotiating, file the lawsuit, and go at them like hairy dogs. If your lawyers are hesitating because they want to talk to the insurance company, then they are not taking your case seriously: they want to take an offer, any offer, and cram it down your throat. In that case, fire them and get a hungry lawyer.

Hell hath no fury like a lawyer on a contingent fee. If your lawyers are acting like Care Bears, replace them.

Your attorney is responsible for finding the guy. Your attorney will have to file suit and have the guy served with process. Once someone finds out they are being sued, they usually fess up pretty quick with who their insurance company is. Keep on your attorney. He should have resources available to him to locate the person, even private detectives if necessary....
