I bought an property 2 years ago, and few days ago, my new neighbor sent me a letter. The letter said part of my driveway is part of their property. So i did my own survay and is true. what happen if my title insurance company did not do a survay on my property? Maybe, but not necessarily. You should seek the advice of a lawyer in your area. check your original survey of the property. That should have been included in it. The title insurance just assures you that there is no liens on your property. Depending on the survey your title company provided - they could. That is, if the original survey that your insurance is based on included the section of drive way then yes they will most likely have to compensate you in someway. However, depending on the circumstances, you may have right to quiet title. That is, if you can prove that for two years your neighbor did nothing to prevent you from using his property he may have surrendered his right to this part of the property.
