Child support/Insurance reimbursement? |
Per child support order my son's father is to provide med/dental/vision insurance but doesn't. My son had an eye injury and had to have glasses and an eye exam that werent covered by his medical card. I had to pay with my credit card can I charge his father a part of the interest since my having to pay for all of the charges were due to his not following the court order? I am giving him 60 days to pay and then asking for interest of 10% after the due date basically in hopes that he will pay quicker. Child support enforcement is involved and other than putting in an IWO when I notify them to does nothing .They are aware of the situation and that the owes me $10,000 in arrears and can "do nothing about that" You can probably charge him the entire amount with interest if he is in violation of the order by not providing the coverage, but he owes at least half, including the interest. The only problem is that if he refuses to pay, you'll have to take him back to court to get it out of him. They are useless in most states! You really need a private attorney, but the up front costs for that are not feasible for many people these days. Report It If he doesn't provide the insurance as required he is repsonsible for out of pocket costs. On our court order we provide the insurance for my daughter but he supposed to be paying a set amt to cover it (not that it does but it's better then nothing)..we are just now getting child support period this past month for the 1st time in 4 years... If he doesn't reimburse you tell him yu are going to take him to court for contempt. That usually will put a fire under his butt and he will know you are serious. It all depends on the support agreement. In mine( I am a father) I am responsible for having insurance for my children if my employer offers it. Since I am disabled now, I don't have to have insurance on the children. Yes, I still do have them covered under other insurance just for all you out there that would want to smash me. But I technically don't have to. Other "medical" expenses that are incurred by the children are to be split 50/50 between mother and father(In my case, not yours necessarily). As far as asking for an interest coverage, I don't think that will work out, or be legal. Check your support papers really good and sit down and talk with the father. If you don't get what you are "supposed" to get, then you can always sit down with a lawyer for a free consultation to find out what you can do legally. Good luck. The father is in violation of the court order for failing to provide the required coverage. First thing...if Child Support Services is not in the picture...get them in the picture their services are free or a minimum $25.00 per year fee. |
