My health insurance is being paid while I'm on FMLA.?


If I don't return to the job do I have to pay the employer back for health insurance? Will a letter from a physician help? The job is way to much stress. I've been out because of serious complications due to diabetes and high blood pressure

It depends on the Insurance laws in your State and the contract that the Health Insurance company you are with has with the Stae Insurance commission in your State.

Having said that, Your employer is paying your premium while you are out on leave, with the assumption that you will be coming back. Most importantly, the carrier is expecting your employer to abide by the rules set forth in the contract that HE/SHE signed when creating the Health plan for the group. In it, I am sure it states that a person who is not working (unless there is an exception) the minimum required hours to be considered full-time (thus eligible for benefits) cannot have coverage.

Bottom line is this...your employer is not asking for the money back to be a jerk. Ya they paid it for you while you are out, but it's more an issue of regulation. A Physicians note is not going to override anything. You did leave one thing out. Did your employer talk to you about what would be required if you did not come back from this leave. I am assuming so since you mentioned it. If so, then you need to step up and be OK with what is going to happen here with those premiums...

If you apply for a new personal plan, it's effective date will not retro back. Carriers cannot backdate applications...and especially if you do an "online" application. They are set to go into effect at 12:00PM midnight the night you apply. However, if you do it immediately and have it effective, let's say May 1, you can term your group coverage. But your employer is still going to ask you to pay those premiums from May 1st back to when you left. If you get your own health insurance policy then if they bother you for a refund you can provide them proof that you had your own policy & they will cancel the other policy back. You may want to try a website that compares multiple companies at once to get you the best price. I am paying less than 陆 after I did.
