My ex was on my car insurance without me knowing he didn't have a licence, what does this mean for me?


I put my ex on my insurance without knowing he hadn't passed his test, he always told me his card was at his ex girlfriends. I understand my insurance was invalid and now I need to show evidence in court that he was driving illegally but I don't want to lose my licence, what does this mean to me if I report it?

I can't understand why you would have been able to have him as a named driver without his having to produce his licence, you could argue that that was the insurance company's mistake. I doubt very much that you would lose your driving license over this, but there is a chance you could be fined, or refused insurance in future. Will he step up and say that he lied to you?

Your insurance should not be affected by this. Had he driven then he would have been liable as he had knowingly driven without insurance or a license. I would say that any police investigation would find you without perfectly innocent.

Gotta go with Oxymoron on this one. I can't understand how your insurance company would have added him without him showing them a license and them verifying that it's valid. Something's missing from your question.

when it is all over i would say to get rid of him without a doubt.

in most cases if it is your first offence you will probably get a fine and maybe points off your licence.
if not your first offence > prison >fine >points off licence.

If you report it then it may indicate to the police you are an innocent party if it comes up later than they are less likely to believe you.

You should have made sure he had a licence, but hindsight is a wonderful thing and doesn't help your situation, so let be positive about it. providing your car has not been involved in an accident and is not damaged in anyway there's no real harm done, OK it maybe your insurance could be void, but that's not the end of the world, you can always get another policy. As for the reporting it to the police, if they have asked you to do a producer, you have no choice, but don't offer information unless they ask. You will soon know whether you have a problem or not.

Unfortunately ignorance of the law is no excuse. You cannot use this as a defence. It is up to you to check the persons credentials on your insurance. I think you will have to throw yourself at the mercy of the court and tell the truth. If the person was driving your car without your permission that may give you some exoneration. I really don't think you have any legal defence to prevent you from losing your licence. If the person that drove the car on your insurance did not have a licence to drive and they ran over someone and killed them you would also be held responsible for allowing them to use your car.
