Where do I stand with my buildings insurance if I don't pay the maintenance fees for my flat? |
My block of flats in managed by a management company who are supposed to clean and maintain all communal areas. I pay 拢50 per month for this and thins also includes ground rent and buildings insurance. However, no cleaning or maintenance work has been carried out on the flats for 3 months so I have written to the management company today informing them that I am withholding my monthly payments until the work is carried out. My only concern is, where do I stand with my buildings insurance if I don't pay? Am I still covered or will I be responsible for covering the cost if for example, my roof blew off! I have my own contents insurance. My partner took similar action when she had a complaint with her factors and within three months she was answering the door to debt collectors and now has had an impact on her credit rating. It was an expensive lesson for her. If buildings insurance is part of your maintenance fees then there is no point in taking out insurance on your own account. You are just storing up trouble about who pays what in the event of a claim. The formula they apply in the event of a claim, for those that haven't met their insurance premiums can be complex, and almost certainly you will share a % of any liability. What I would advise is that you withold a percentage of the fee explaining in writing why you are doing so and associate it directly with the cleaning issues you have. You should always make these complaints in writing or by email, telephone just doesn't leave an audit trail! The 拢50 will also contribute towards communal lighting, a wear and tear account for items needing replaced etc. All this will be set out in the legal documents you signed when you bought the house. you should have your OWN contents insurance, if you own your flat you need your own buildings insurance also, just for peace of mind!! if you rent your flat and your roof was blown off its the responsiblility of the landlord to arrange repair and PAY for any damage, the landlord themselves will have buildings insurance, i reccomend you take out your own policy and have whoever manages your flats deduct the buildings insurance from your maintenance charge, 拢50 a month is a lot to pay for someone to hoover stairs and mow the lawns! |
