In Calif, is it possible to sue a car insurance company for PUNITIVE damages if they don't pay on a claim? |
In some states, a person can only sue the insurance company for the cost of the actual repair. In a few states, ppl can also sue the insurance co. for PUNITIVE damages (thus hopefully encouraging them to pay up). What is the situation in California? Thanks. Actual damage and even then you have to mitigate costs. Car in storage awaiting auto-garage bill be paid while you're in a rental as a result of a car accident would be actual damages. Therefore storage fees and rental costs would be in addition to the actual repair. But even then, I believe you sue the registered owner who then gets their insurance to pay the judgment. Insurance company is not going to pay a demand for punitive damage. I don't think any states allow punitive damages in this case. |
