Someone crashed into my car their insurance wont pay what do i do ?? helpp ???


let me explain
someone crashed into my car on the left backside the police report says she had to have alot of attention and that if she was paying attention the crash wouldnt have hapened so i sent all this to her insurance company and they only want to pay half its not fair i didnt do anything the repair is going to cost about 2000 what should i do and how do i find a lawyer if i need one

Sue, and finding an attorney is simply opening a phone book.

It sounds like they are just trying to settle the claim cheaply. Do not fall for it. If they are nitpicking your repair estimate, they will need to find a reputable shop to do the repairs for that price. I would tell them you want them to go ahead and have the repairs done for you, and do not take a check or sign a release. That way if the repairs do not bring your car to pre-accident condition, you have grounds to complain about the repairs.

Just because they made an offer, doesn't mean the issue is closed. You just need to be assertive with the adjuster.

give this to YOUR insurance and let them fight it for you. You'll get fair value that way.

Insist that your own insurers deal with the claim in full and threaten them with the possibility of losing your business if they do not. They have a duty of care and you should not allow them to indulge in their cosy "knock for knock" agreement with another company which is probably in the cartel. If all else fails, write to the Insurance Ombudsman.

Same thing happened to my sisters boyfriend. Some trucker ran him off the road. He was driving his brand new black jaguar and the damage was just over $10,000 to fix it not including the car rentals, the truckers insurance refused to pay for the damages so he took them to court and got $50,000. Sue them personaly, it will take a while but it will be worth it. Just look up a laywer in the phone book, make sure that you keep looking untill you find a lawyer who seems very eager and interested in your case.

First off sorry to hear about that. Secondly insurance companies will do anything to get out of paying a claim. Go to your insurance company and get a hold of your claims department. It also helps if you have a decent relationship with your insurance agent, if you do they can call the company as well and try to find things out for you as well as advise you on what to do during this process. Because it is going to be a process. Get a hold of a lawyer and call the insurance compay of the person that hit you. Tell them not only will you be sueing for damages, but now you will be going after them for the fees for the lawyer you had to hire cause they wouldn't pay. This will get you attention. Next step is making sure you have duplicates of all the documents that you have sent out, because companies have a miraculous way of misplacing esential documents. Especially if its the document that proves the fault of their driver. Outside of that you may wind up trying to sue the driver directly if the insurance company dosn't pay. That will go to small claims court and be a process in itself. Basically momentarially your screwed, in the long run you may get your money back. No way to know for sure, thats americas legal system for ya!!! Good luck!
