Can I press charges for theft of insurance reimbursement check that was sent to ex? |
He is under court order to reimberse half of my out of pocket expenses. Not only has he 90 days past due.I was informed by the insurance company that the charges were 100%. They issued a check for the full amount and mailed it to my ex. on Feb. 12th..He laughed and said "sue me".. Well, if you can find out if the check was made out directly to you, I would suggest telling him that you are going to report him to the post office. It is a real felony to interfere with the US Postal Service. Mention to him that the FBI are not pushovers like the police are. They'll go through his life with a fine tooth comb. Legally, yes. Firstly how much are we talking and is it worth the headache of a lawsuit, after lawyers fees etc..... is it worth it. If you feel that it is then do it the right way and go for it. GOOD LUCK!! Is your ex the insured/policyholder? If he is the named insured or policy holder, the insurance company would have issued the check to him, payable to him, regardless of who the benefits were paid on behalf of. If this is the case, and the check was payable to him and he negotiated the check, he has not committed any crime. If the check was payable to you, however, and he forged your name on the check to deposit it, that is a different story. I'm not sure that the FBI is the agency you'd report that to, however. As far as enforcing the court order requiring him to reimburse you for half of your out of pocket expenses, if he will not willingly do so, you will have to haul him back before the judge who issued the order. The judge will see to it that he pays you what is due. Good luck to you! |
