Got a "notice to appear" for Illegal U-turn... will my insurance rate go up?


it is a notice to appear in court... for making Illegal U-turn (vc22102)....
i wanna protest it, but if i lose, will my insurance rate go up?
and if i win, will my insurance rate go up as well?

and another question is that is it possible to fight the case without going to the court? i heard that i can just write a report and submit the evidence. how do i do that?

This is hard to answer and it always helps to know what state you're from. In my state, the best I could do is a "maybe." Do you have a clean driving record? If so, plead quilty and ask for a "deferred sentence". That could be called something difference in your state. Whatever it's called, it does not get reported to the state DMV or the insurance company. After the period of deferment--90-180 days depending of the judge--the case is dismissed without action. Do not take the risk of not appearing. Then you could be convicted and a bench warrent issued for your arrest. If you think you're not guilty, go to court and tell the judge your side of the story. You can still ask for a deferred sentence if your convicted---IF you have a good record. Protesting or pleading to it will not make a difference on the insurance rates--what your goal should be is to get in deferred, i.e. not reported. Go to Court early and talk with the police officer. Tell him/her you don't want your insurance rates to go up and ask him/her to support your plea. If you are courteous, they'll almost always do it. If you go and the officer is not there, ask the judge to dismiss the charge. I have never heard of fighting it without going to court, but every state has its differences.

You'll need to go in person to fight it. If you lose and are convicted, your insurance will be notified and the violation will raise your rates.
In CA, where I live, if you plead guilty and agree to attend a certified traffic school and can send the court proof of that, they do not go up.

well tell the judge you just had to get to the other side you thought you seen a dog hitting 90 mph to cross your path it might work i have not tried it yet.

Most insurance companies do look at driving records and use them to set rates. If you have other violations on your record then it could cause a rate increase. It depends on how bad the record is.

One ticket usually doesn't raise your rates, I got a careless driving charge some time ago, and still haven't noticed an increase in my insurance. I guess it also depends on your age. If you're younger than 25, you'll probably get zinged for anything at all (insurance rate wise)

You can't fight this without going to court. Even if you plead guilty, there are usually benefits to appearing:

1) the cop might not show up;
2) if it's your first offense, the judge might give you probation;
3) if the judge has a populist attitude toward the insurance racket, he or she might have you pay the fine but change your offense to a lesser one without points.

I've experienced all of the above.

Its a moving violation.....how many more do you have in the last 3 yrs?
