Fmla question - do you only have to pay back insurance? |
if you are off on fmla for maternity leave and you decide to quit after returing to work - the only thing they can make you pay back are the insurance premiums???? is that correct??? I do not carry our insurance, my husband does. So it was not taken out of my paychecks if you had already accrued paid time off be it vacation time or sick time that is an earned benefit. FMLA is unpaid leave you only have to repay things that the company paid for you. you state they do not take out anything from your check except taxes, soc. sec. , medicare so they would have not paid anything for you to repay. if they paid anything that normally would have been paid by you then you have to repay it no exceptions. you have stated a number of times that they have not done that so you have nothing to repay. sick days and vacation days are accrued you earn them prior to taking them so you don't owe for those days. if t you intend to go back to work for this employer or any other you owe them the courtesy of giving them as much notice as possible. you do not have to go back to work but you owe it to your employer to let them know, by law if you were out on FMLA they have to bring you back so if you are going to quit they may need to fill a position. let them know your plans immediately and quit worrying about what you may have to repay. you shouldn't have to pay back anything....its already pre paid you had it taken from your paycheck right?? so while your out the only thing you paid for is insurance to keep everything in balance when you are released then you can just quit and there isnt anything anyone can do about it |
