If a company cancels it's Workman's Comp. insurance & you get injured on the job, what actions can you take? |
I've seriously injured my back & need treatment. What are my options? I don't have health insurance. You can sue them. In most states workman's comp. is required. If they are really liable they will pay dearly--I would rather pay your bills than have an official find out I didn't have workman's comp. contact a lawyer ,like now and go after the co. I thought it was mandatory!!!!??? Sue them; they're not supposed to be operating without worker's compensation, unless you were hired to work for that company as a contractor. Some companies do the latter, so that they don't have to go to the headaches of withholding taxes, providing worker's compensation, and so forth. states require that companies have workman's comp. if you remember when Michael Jackson had to let go all of his employees because he could not afford the insurance. Find a lawyer that works in Workman's Comp. specifically. you can file workman's comp paperwork once received by the state they will investigate & determine the company has no insurance and they will have to reinstate it and pay fines. contact a lawyer that specializes in workman's comp cases and go from there. you will have to go through several hearings and if they determine you are permanently disabled they will give a percentage rating based on that & determine the amount of the settlement you will receive , the company will also be responsible for your medicals bills even if you stop working for them as long as it's not a new injury. good luck Contact a worker's comp attorney. |

Get a good lawyer and go after them, even if you were in the wrong, most jury's will side with the little guy instead of the big-bad insurance company. What will...
