If a person sues you after a wreck,& your insurance has paid all they are liable for,can they get more? |
My daughter had a wreck last August, her insurance paid the full amount to the people, but it wasnt as much as the value of their car, now they're suing her for the rest of it. Can they get anything? She has nothing & we've had to finish off paying for her car & we've paid many of her bills since she ran away"to be own her own", Now she's living w/a couple in the city where she's working & rides a bike to work. She said she couldnt pay her rent any more on her own place. Even w/us Helping her, & she snuch back in w/one of her old boyfriends.,who had lost even visitation rights w/his daughter!! then she moved,to the other people's house, the things we bought her are at he boyfriends place! Should we go w/her to court? what should we do? The more we help her,the worse she gets! & she's doing some things we really are leery of!! they've got all her insurance & she makes 7.50 hr. Do I know how you feel. Mine is to scared to drive and so that has saved me on that issue, but, the rest is the same. yep .. they can get about everything except your home in most states. Two words -- tough love!!! You need to let her bail herself out of some of these things, else she will NEVER learn. You need to consult a lawyer. Really. Don't wait. Honestly, and please don't be offended by this, you shouldn't help her. What does she learn if you just yell at her for it (assuming you do that)? She's old enough to know better if she thinks she can "live on her own"... that means without you guys. Either she follows your rules or she pays for herself. And if she ends up in trouble with it- that's not your problem is it? It's hard as a parent, I'm sure (I wouldn't know, I'm 15 lol), but I know people who've done that to their kids and now they feel (as adults) like they're entitled to everything they want. She should visit a bankruptcy attorney as she can be sued for the difference and her wages garnished if they win their case. |
