Can i be compensated for driving around with no insurance do to there neglegence? |
its a long story but here it goes. i went down to the ford dealership on 6/14/2007 and they sold me a 2007 ford focus about a 2 weeks later they called me up and said that i needed to come in and sign a new contract with higher monthly payments because they were having trouble finding me a lender under the original agreement. so when i went in i told them that if i had to sign a new contract that i didn't want the car . so what we decided to do was to purchase a used vehical (2006 chevy malibu) and write up a new contract for that transaction. ok so now heres the deal , i got into an accident on 08/01/2007 and thought i was covered under the 30 day binder but i just got a call from the insurance company and they said that i am not covered because the dealership never sent them any paper work for the chevy malibu and that the binder began on 06/14/2007 which was the date i i originally got the ford focus and they don't know anything about the chevy malibu. Good luck but no. Well, you'll still have to pay the person who you hit, but then you can counter-sue the dealership for the money you paid out. You are responsible for insuring your cars. I'm wondering if the 30 days even applied. 2 weeks from 6/14 is 6/28. Another 30 days from that is 7/28 so you were beyond the 30 day limit anyway - bad judgement on your part. You are responsible to get insurance on your car. If you didn't do that, why is it someone else's fault? It's not up to a car dealership to sign you up for insurance. When I buy a car, the first thing I do when I get home is call my insurance and add the new car. Why didn't you do that? What is a binder? Did you think you were covered? Still, 8/1 would be outside the 30 days from 6/14 or 6/28. It was your responsibility to get your own insurance policy. Never mind that it is really fishy that they let you have the Focus without financing solidified when you signed the contract. Finding a lender happens when you submit to a credit check and apply for a loan. But still, you should have gotten your own insurance right away. I do know that the dealership has so many days to file the paperwork and that a rider covers the vehicle. It is not your vehicle until DMV recognizes it. Hmmmm If you are not insured here, the vehicle registration is no longer valid. In fact, a valid certificate of insurance would have had to be filed for it to be registered in the first place. What state is this in? I may want to avoid it. Probably not. If you read your insurance policy carefully, it should contain a clause about you being responsible for contacting them if you should sell your vehicle or buy a new one. The dealership usually provides you with insurance for only a very short window of time, say 3 days. |
