How much authority does I.C.E. have over our judicial system on grounds of deportation?


Are there loop holes in the law that could protect an illegal immigrant? Or is the law clear--illegal is illegal and they have to go back? Is it possible to sue the court system for not upholding immigration laws--for sweeping it under the rug?

ICE has no authority over the courts at all.

They are an enforcement agency, and therefore part of the Executive branch of government.

The courts fall under the Judicial, and are outside the ability for ICE to influence their decisions.

Over immigration matters ICE has complete control. There are federal immigration administrative law judges that decide deportation matters.

Yes, there are loopholes, but an illegal immigrant needs to obtain the advice and assistance of an attorney to take advantage of these loopholes. The law is complex and complicated.

You cannot sue the court system for failure to uphold immigration laws. You can sue ICE, but probably will not prevail because they have the discretion to decide which cases to pursue and which not to pursue.

    Usually not. They certainly can't charge you if you call them to ask whether or not they'll charge for the initial consultation. Don't know about immigration specifically.
