Failure to report ALL income on tax return, Tax Evasion or Tax Fraud? or BOTH?


My "ex" entered into a relationship with me for the sole purpose of swindling me out of as much money as possible. During which she perpetrated "Immigration, Marriage, and Insurance Fraud."

If my spouse failed to report all of this money and benefits recieved through their DECEPTIONS, to obtain a larger Tax Refund (and to avoid paying any Taxes on this income too), can they be prosecuted by the Internal Revenue Service?

Both.
Tax evasion falls under the umbrella of Tax Fraud.
It's just one form of tax fraud.

Yes they can be prosecuted. If you filed joint returns than you can be prosecuted as well. If you did, contact a lawyer to straighten it out. The IRS will be much easier on you if you bring the 'discrepancy' to THEIR attention.

Yes. Willfully failing to report all income is a felony.
