Immigration/custody?

I'm 21, married, with a 5 month old son. My husband is abusive. He's also kept me locked in the house for two years, and cut off all my contact with friends. He also cheats.

I'd like to get a divorce. But I'm currently in the middle of spouse immigration. If we break up now, I have to leave the country. And if I didn't have to, I'd want to. That means a custody battle over my son, who was born here. Also, my having been locked away for two years while my husband worked, isn't going to look good in the "responsibility" area. Fair enough except that my husband honestly doesn't give a damn about his son, and will waste his last cash on booze while I'm scraping pennies out of the couch for baby formula. I can't leave my son with that.

I also have no cash of my own, and no access to his.

I need out of this situation before it breaks me, and I don't know how. I have zero proof. Any ideas, any knowledge of divorce/custody proceedings and my chances, would be very very much appreciated

Suggestions:

1. Look at the Australian government web page on Family Law (Divorce, Child Custody etc...) @ http://www.australia.gov.au/149

2. Get (maybe borrow one from a friend) a video camera and when he trys to assault you next take a video of it... then you will evidence against him

3. Get a friend to come home with you and WITH your friend present have a conversation with him about the whole situation and then you will have a witness to his creulty

4. Talk to some friends about the situation.. about how you would have worked to support your child however he had locked you up... more witnesses for you

--Get evidence... friends/witnesses, video evidence whatever you can get

r m is right you should get a hold of your baby and go to your embassy ASAP!!
They will probably take care of you and your child while you are there

Go back home with your child. Make arrangements with a friend or family member to get out while you can. You can always try to document your husbands alcoholism with bank statements or receipts, pictures, or any criminal records he has obtained due to his drinking. Then you can fight your custody battle efficiently. I feel your pain as I left a useless husband who caused me a lengthy EXPENSIVE custody battle for only God knows what reason. I must stress that if he's truly an alcoholic, THERE IS PROOF!!!! YOU MY DEAR ARE RESPONSIBLE FOR FINDING IT! Take care of that sweet child, he needs you to protect him until he can protect himself. Try contacting your embassy in Australia and ask them for help or advice.

Go to YOUR embassy in Aussieland, speak to legal councel there. Get them to help you and your baby back to holland.....Even if you have to make this statement to them " I am a citizen of Holland and am seeking assylum for myself and my baby" Once you say that, they cannot make you leave the embassy, DON"T tell your husband that you are doing this!!!
