Is congress in charge of immigration?
Is there any torts a city would violate if it made laws regarding immigration which is the authority of the federal government?

First it goes through Bush,if the congress is not happy with what Bush agrees on then the congress will have the last word, unless Bush veto's it, then its just all a mess up America....but what congress agrees on a 100% vote.. then congress rules over Bush.

Yes. Immigration is a federal government issue and therefore Congress can legislate it and the Supreme Court can rule on it.

Technically, any city or municipality that issues laws contrary to federal law is in violation of the federal law. The case can be elevated to federal courts.

And I hope the federal courts hand Hazleton, PA a good slap in the face for what it has done!

I thought they were in charge of just about everything!

Local governnents cannot set immigration policy for themselves or for the state or for the federal government. What they can do is find new and innovative ways to make sure that the laws that have been enacted can be enforced.

If I were to try an enact a local tort for the purpose of actually enforcing the laws on the books, it would start out with a restatment of the existing laws. Then move to a therefore since it is the policy of this local government to help uphold these laws, we shall enact the following reporting requirements of all such people as we want to regulate (i.e employers or renters.) and we shall require a fine be imposed upon those that either will not report or that enable the violation of the aforesaid federal statutes.

This is perfectly legal and used daily in other law enforment areas such as drug trafficing, etc.
